1. GENERAL PROVISIONS

Order – is a document that constitutes a single form of ordering hotel services available on the website: mountain-residence.com.

Seller – LLC "Hotel Art Management ", 78593, Polianytsia village, Yaremche district, urochyshche vyshni 504.

Buyer – is a person who has the authority in accordance with the norms of the current legislation of Ukraine to conclude a contract and make a payment under this contract in order to receive hotel services.

Guest(s) – the person(s), who is actually entitled to use the service.

Hotel service – actions (operations) of the Seller to accommodate the Buyer and Guests by providing a room (place) for temporary accommodation in the hotel, as well as other activities related to accommodation and temporary accommodation.

Booking – a timely pre-order conducted by the Buyer, of hotel services in full amount, in order to claim the services in due time.

  1. HOTEL SERVICE RESERVATION PROCEDURE

The order (booking) of hotel services is made on the website  mountain-residence.com and done by the Buyer independently filling out and sending the application form. For the consequences resulting from the records incorrectly submitted by the Buyer in the application, the Buyer is fully responsible. The Seller is not responsible for the lack of access to the sales system for reasons independent of the Seller, from the point of view of security and other reasons independent of the Seller. The seller has the right to suspend access to the site mountain-residence.com to eliminate emerging threats or incorrect data. The order is considered completed after payment and transfer of funds to the Seller's current account.

Registration form. When filling in the registration form, the Buyer shall fill in all fields marked with an asterisk. The information entered by the Buyer regarding his/her surname, name, address, telephone number, and e-mail must be accurate. If the Seller finds in the filled-in fields of the registration form verbal designations that deliberately do not comply with the rules of spelling of surnames, names, and addresses and do not allow the Buyer to be identified, such order will be canceled without notice.

  1. PAYMENTS

The payment currency is Ukrainian Hryvnia (UAH).

The cards being accepted by the payment system are VISA (except Electron and Domestic), VISA Electron, Mastercard (except Cirrus and Maestro), and PrivatCard.

In case of hotel services being paid with bank cards via reception desk terminals or electronic systems which require personal data provision (card name, card number, validity term, CVC) to the Seller or authorized third party, for any purpose, including but not exclusively for the purpose of card blocking and/or funds debiting, the Buyer should, while checking-in, confirm that they are actually the owner of the card being charged.

In case such information is denied, the Seller may use the denial of service right, in order to prevent fraudulent card use, which means transactions performed without permission of the actual owner (including lost/stolen/modified bank card abuse) and/or using the requisites without owner’s consent (including fraudulently-obtained information).

  1. TERMS OF SERVICE
  • Payment for the ordered services confirms that the Buyer has read the Booking Conditions posted on the website and constitutes the conclusion by the Buyer of the Agreement with the Seller for the ordered and paid hotel services in accordance with the following conditions.
  • Payment for the Seller's services is made by the Buyer by non-cash transfer of funds to the Seller's current account within the period specified in such account. In case of non-payment of funds by the Buyer on time, the order becomes invalid and the reservation is canceled without notice.
  • The moment of payment is the day the funds are credited to the Seller's current account.
  • Booking by the Buyer of the Seller's hotel services is carried out by providing the Buyer with an order for booking services in accordance with the form established by the Seller and making a preliminary full payment of their cost to the Seller's current account.
  • The Parties agree that in case of late cancellation of the booked hotel services ( less than 3 days before the day of arrival ), non-arrival or interruption by the Buyer of hotel accommodation, regardless of the reasons, the preliminary payment in the amount of 100% of the cost of paid services for the entire period of stay is not refundable and is credited to the Seller as a fine for the Buyer's failure to comply with the terms of this agreement. In this case, this reservation is canceled. At the same time, the parties agreed that if the terms of the payment system through which the relevant transaction is carried out entitle the Seller to withhold a fine from the Buyer in the amount of the cost of one night of accommodation, then in this case the cost of one night of accommodation when collecting a fine is equal to 100% of the total cost of accommodation for the entire period of residence of such Buyer.
  • If hotel services are booked less than 3 days before the day of arrival, cancellation of the ordered services by the Buyer is not allowed. The Parties agree that as a result of non-profit, advance payment in the amount of 100% of the cost of paid services for the entire period of residence is not refundable and is credited to the Seller as a fine for the Buyer's failure to comply with the terms of this agreement. In this case, this reservation is voided.In this case, the parties agreed that if the terms of the payment system through which the relevant transaction is made, give the Seller the right to withhold a fine from the Buyer in the amount of the cost of one night of accommodation, then in this case the cost of one night of accommodation when collecting a fine is equal to 100% of the total cost of living for the entire period of residence of such Buyer.
  • In case of a timely cancellation of the booked hotel services (more than 3 days before the day of arrival) by written notification by the Buyer of the refusal of the Seller's services, the Seller is entitled, subject to the availability of a number of rooms, to postpone the reservation for another period or credit the funds received from the Buyer against payment of his other obligations.
  •  If the Buyer cuts short their stay at the hotel Buyer’s advance payment is not refunded.

 

  1. CONFIRMATION

All hotel services ordered through the mountain-residence.com website are confirmed by the Seller. Confirmation of payment for services is the receipt of an automatic email with information about receiving payment.

  1. CHECK-IN 

The hotel guarantees the availability of the booked room for check in from 3 pm

Registration of temporary accommodation in the hotel is carried out at the reception by filling out the guest questionnaire and issuing a plastic key card.

Key-card is a pass of the Buyer to the hotel for a period not exceeding the period of paid accommodation in the hotel.

Transfer of the key card to the Buyer and its return is carried out according to the act of acceptance - transfer of the key card, which is signed by the Buyer and the representative of the hotel at the reception.

  1. SELLER’S RESPONSIBILITY

The seller is responsible for the quality of services. The seller is not responsible for force majeure and temporary inconveniences caused by the fault of third parties caused, for example, by a temporary lack of electricity, as well as inconveniences caused by temporary repairs, for example, repair or preservation of equipment. In case of emergency, independent of each party, natural disasters, strikes, hostilities, or other emergencies that do not provide the opportunity to provide services in accordance with the agreement, the Seller is not responsible for the obligations assumed. Claims to the terms of service are accepted in writing at 78593, s.   1. PERSONAL INFORMATION

The Buyer and/or the Guest give the Seller consent to perform, without limitation, any actions to process their personal data in order for the Buyer to carry out activities in accordance with the legislation of Ukraine, fulfill the terms of the concluded hotel services agreement, exercise and protect the rights of the parties under the concluded hotel services agreement, perform other powers, functions, duties of the Seller that do not contradict the legislation of Ukraine and the terms of the concluded agreement.
