Order – a standardized document that formalizes the booking of a hotel room, available on mountain-residence.com website.
Seller – PE Rusanova, 78593, Polianytsia village, Yaremche district, Vyshnyi tract.
Buyer – an entity in power to perform acts under provisions of the current Ukrainian legislation and who enters into a contract and provides payments under this Agreement for the purpose of obtaining hotel services.
Guest(s) – the person(s), who is actually entitled to use the service.
Hotel service – actions (operations), conducted by the Seller in order to accommodate Buyers and Guests by providing rooms for temporary housing in a hotel, as well as other activities and services connected to accommodation.
Booking – a timely pre-order conducted by the Buyer, of hotel services in full amount, in order to claim the services in due time.
HOTEL SERVICE RESERVATION PROCEDURE
Hotel services reservation (booking) at mountain-residence.com is fulfilled by completing and returning back the corresponding booking form. The Buyer alone is fully responsible for the consequences resulting from information being incorrectly submitted into the form. The Seller is not responsible for computer system’s access problems, which emerge from force majeure factors and other reasons beyond Seller’s control. The Seller has the right to suspend access to mountain-residence.com in order to eliminate threats or incorrect data. The order is considered completed after a successful transfer and funds been deposited into Seller’s current bank account.
Upon receipt of a fully-completed booking form, the Seller mails an invoice to the Buyer for payment, which indicates the cost of services being booked.
Booking form. In the process of completing the form, the Buyer is obliged to fill in all the fields marked with "*". The information provided by the Buyer concerning their full name, address, telephone and fax numbers, e-mail address must be accurate. If the Seller detects a fragment which doesn’t comply with the full name and address spelling rules and makes it impossible to identify the Buyer, the order will be canceled without further notice.
The payment currency is Ukrainian Hryvnia (UAH).
The cards being accepted by the payment system are VISA (except Electron and Domestic), VISA Electron, Mastercard (except Cirrus and Maestro), PrivatCard.
In case of hotel services being paid with bank cards via reception desk terminals or electronic systems which require personal data provision (card name, card number, validity term, CVC) to the Seller or authorized third party, for any purpose, including but not exclusively for the purpose of card blocking and/or funds debiting, the Buyer should, while checking-in, confirm that they are actually the owner of the card being charged.
In case such information being denied, the Seller may use the denial of service right, in order to prevent fraudulent card use, which means transactions performed without permission of the actual owner (including lost/stolen/modified bank card abuse) and/or using the requisites without owner’s consent (including fraudulently-obtained information).
TERMS OF SERVICE
By making an invoice payment, the Buyer agrees to the booking rules and provisions and enters the Agreement with PE Peredruk O.V., in order for the last Party to provide services under the terms listed below.
The payment for the services provided by PE Peredruk O.V. is fulfilled by making a transfer of funds to the running account of PE Peredruk O.V., within the time frame specified by the invoice. In case of non-payment, deficient payment, and/or the Buyer fails to make a timely transaction, the invoice becomes invalid and reservation is canceled without further notification.
Overdue payments are not refundable, still those extra funds may be accepted as payments for future services.
The moment of payment is considered the day of a successful and sufficient money transfer to the running account of PE Peredruk O.V.
Service booking is fulfilled by sending a request (according to the standard form issued by PE Peredruk O.V.) and making an advance payment of service’s full value to the running banking account of PE Peredruk O.V.
A successful, sufficient and timely payment according to the bill - confirms the reservation and conclusion of the Agreement.
The Parties agree that the untimely notification (less than 20 days prior to the arrival date), failing to arrive or untimely refusal from services (regardless of the reason) is considered breaking the Agreement and causing financial damage to PE Peredruk O.V.. The penalty amount is equal to 100% of advance payments. The money amount paid by the Buyer in advance for the entire period of their stay is commissioned as penalty in order to cover the financial losses of PE Peredruk O.V.. The Parties also agree that in case of given payment system and/or transaction implies that penalties are charged by the Seller at the rate equal to the cost of 1 night of accommodation, the 1-night accommodation rate will be modified to match the full pre-paid amount for the entire period of Buyer’s stay.
If a reservation is made less than 20 days prior to the arrival date, the Buyer is unable to cancel the order. The Parties agree that if the Buyer fails to arrive, this is considered breaking the Agreement and causing damages to PE Peredruk O.V.. The penalty is equal to 100% of advance payments. The money amount paid by the Buyer in advance for the entire period of their stay is commissioned in order to cover the losses of PE Peredruk O.V. and the booking is canceled. The Parties also agree that in case of given payment system and/or transaction implies that penalties are charged by the Seller at the rate equal to the cost of 1 night of accommodation, the 1-night accommodation rate will be modified to match the full pre-paid amount for the entire period of Buyer’s stay.
If the Buyer informs about the cancelation in due time (20+ days prior to the arrival date), PE Peredruk O.V. has the right to reschedule the reservation to another period, subject to free rooms availability, or to use the advance payment to cover the costs of other services previously booked by the Buyer.
If the Buyer cuts short their stay at "Bukovel" family hotels or other lodges run by PE Peredruk O.V., Buyer’s advance payment is by no means refundable.
By paying the invoice the Buyer confirms they agree with the terms listed below.
All hotel services being sold at mountain-residence.com should be verified and confirmed by the Seller. Payment confirmation is considered to be an automatic email with payment information.
CHECK-IN PLEDGE MONEY DEPOSIT
Accommodation is formalized at the reception desk, with filling in the guest personal data form and issuing a plastic key-card. A key-card is the Buyer’s pass to the hotel, it also acts as a ski-pass for the entire duration of Buyer’s stay, subject to skiing services being purchased. Buyers receive and return their key-cards according to the Act of acceptance, which is concluded at the reception desk by Buyers themselves, together with a hotel administration representative.
The Seller is accountable for the quality of service. The Seller is released from liability in cases of force majeure circumstances and short-term inconveniences and technical malfunctions, caused by a third party and result in electric power absence, short-term repair works, e.g. equipment repair or conservation. In case of force majeure circumstances, e.g. natural and man-made disasters, military operations, hostility acts, etc, which do not allow to provide services under the Agreement, the Seller is not liable for any inconveniences caused to Buyers and Guests. Buyers and/or Guests give their consent regarding their personal data being freely processed by the Seller for the purpose of: carrying out business activities in accordance with the current legislation of Ukraine; fulfillment of the conditions under the concluded Agreement on hotel service provision; realization and protection of the rights of the Parties under the concluded Agreement on hotel service provision; fulfillment of other Seller’s rights, duties, obligations as an employee, which do not contradict the Law and the terms of the concluded Agreement.
